1 The appellant, Winfred Palmer, hereinafter referred to as defendant, was charged and tried before a jury in the District Court of McCurtain County for the crime of Shooting With Intent to Kill. The defendant was convicted for the crime of Assault With a Dangerous Weapon, Case No. CRF-74-32, and punishment was assessed at one (1) year in the state penitentiary.
